The Terms and Conditions of service and use of www.inteligex.com are hereby effective as of the Nov 1, 2018 by Inteligex LLC registered in Wyoming.  (‘Inteligex’ or ‘we’ or ‘us’ or ‘our’). These may be updated from time to time and the most up to date version will always be found here.

The following Terms and Conditions govern the use of our site and associated services.  If you do not wish to be bound by these then you may not use our services or browse the website.

Together the ‘Terms of Use’ and ‘Privacy Policy’ form the key elements of your relationship with Inteligex.  By using the site and/or the service you consent to the clauses in both of these sections.

The Service

Inteligex is a business which develops and licenses software tools that analyse trends in data patterns.  These tools consist of intelligent algorithms that attempt to predict movements in several financial markets based on historic and live market data.  These software tools act as plug-ins to market charting software packages that are currently available from other providers.

The service provided by the Inteligex tool is to give information to ‘customers’ (those who have paid for an Inteligex license/subscription package) as to the potential movement of the market.  Any investment decision is entirely down to the customer in question and use of the tool does not constitute ‘investment advisory services’ as governed by the Investment Advisors Act of 1940 (or similar geographic specific financial advisory legislation). Inteligex either via it’s software algorithms or information on it’s website does not engage in the business of advising you (or others) as to the value of securities, the advisability of investing in, purchasing or selling securities.  Inteligex is merely a statistical tool which provides forecasts of market movements.

No data, content or information provided by Inteligex is intended to, and shall not constitute or be construed as, advice or any recommendation to buy or sell securities.

Data Accuracy

The Inteligex software tool runs on 3rd party market charting software programs.  Inteligex is not responsible for the accuracy of information from these 3rd party tools and therefore cannot be liable for any inaccurate or untimely information from these sources.  Any issues relating to the accuracy or timeliness of data from these 3rd party sources must be addressed directly with those 3rd parties in question.

Use of Information

You agree not to copy, reproduce, modify, create derivative works from, distribute or publicly display any content (except for your own information) from the Service without our prior written permission.

You consent to information about the device you use to access the Service being collected and processed for fraud prevention purposes and we may use third parties (and information they provide) to help us prevent fraud or unauthorised access to our Service.

Use of Inteligex Tool

The purchase of Inteligex gives you a single user license for the use of the software on multiple markets and indices. By using Inteligex you hereby agree to the single user license of Inteligex and not to share user ids or passwords with other people who have not subscribed to the service. In addition you agree not to share or publish the signals produced by the Inteligex tool in any format whatsoever including the publication or communication of screenshots containing the Inteligex Control Panel or Inteligex Signal Indicators. For avoidance of doubt any attempts to pass on Inteligex signals (or trades indicated by them) to other users for your own commercial or personal gain violates the single user license agreement.

Inteligex reserves the right to remove users, without refund, who do not comply with this license and pursue legal action as appropriate.

Intellectual Property Rights

You acknowledge that all present and future copyright and other intellectual property rights subsisting in, or used in connection with, the Service or any part of it (the “Rights“), including the manner in which the Service is presented or appears and all information and documentation relating to it is our property (or that of our licensors), and nothing in these Terms of Use shall be taken to transfer any of the Rights to you.

Solely for the purposes of receiving the Service, we hereby grant to you for the period during which the Service is provided a non-exclusive, non-transferable, license to use the Rights.

Inteligex is a proprietary software tool, you must not try to access the source code of the Inteligex tool in any way.  Inteligex reserves the right to remove users, without refund, who do not comply with this requirement and will also report the attempted theft to the appropriate authorities.

Forum Code of Conduct

The forums have been established to provide you with a friendly and safe environment to share your views on the use of the Inteligex tool and the markets.  Community forums are at their best when participants treat their fellow posters with respect and courtesy. Therefore, we ask that you conduct yourself in a civilized manner when participating in these forums.  

If you do not do so we reserve the right to remove your access to the forums and cancel your Inteligex subscription without refund.

All conversations within the forum should be factually accurate, courteous and should not include language or content which can be construed to fall under the following categories:

Distribution of Real-Life Personal Information

Posting Cheats, Hacks, Trojan Horses or Malicious Programs

Major Religions or Religious Figures

Spamming or Trolling
Creating Duplicate Threads
Cross Linking Threads
Advertising
Discussing Disciplinary Actions
Circumventing a Suspension / Ban
Use for Personal Gain

Our Rights

We reserve the right at all times to edit, refuse to post, or to remove from the Service any information or materials for any reason whatsoever, and to disclose any information we deem appropriate to satisfy any applicable law, regulation, legal process, police request or governmental request.

We reserve the right to restrict your access to the Service at any time without notice for any reason whatsoever.

Without prejudice to the generality of the above, we reserve the right to restrict your access to the Service at any time without notice in the event that we suspect you to be in material breach of any term of these Terms of Use.

We reserve the right to modify or discontinue temporarily or permanently all or part of the Service with or without notice without liability for any modification or discontinuance.

We may vary these Terms of Use from time to time and shall post such alterations on the Service.
